SAP has admitted in court that it owes Oracle tens of millions of dollars because its defunct third-party TomorrowNow support subsidiary infringed Oracle’s copyrights when it plundered Oracle’s software and documentation but SAP drew the line and claimed the industrial espionage doesn’t amount to the better than a billion dollars that Oracle contends.
Oracle caught TomorrowNow pilfering its IP to service PeopleSoft and JE Edwards customers it attracted with steep maintenance discounts. Oracle claims that SAP knew what the unit it bought was up to before it closed the unit in 2008 in the wake of the 2007 suit and let it go on. The trial is now scheduled to start in November.
